SWEEPSTAKES PERIOD: The Classic Chevrolet Cruise in a Cruze begins 2/8/11 and ends 4/1/11. Registration period: 2/8/11-3/24/11.
WHO MAY ENTER: Contest is open to legal residents of Texas and Louisiana, age 18 or older as of 02/01/11, who have a valid Texas or Louisiana driver’s license. Employees, officers, directors and agents of Classic Chevrolet, KFDM Channel 6 and each of their respective parents, affliliated companies, subsidiaries, distributors, advertising and promotion agencies and all other companies associated with the design or execution of this contest and the members of their immediate families (spouse, parent, sibling, child, and their respective spouses, regardless of where they reside) or households, whether or not related, of any of the above, are not eligible to enter or win. The Contest is subject to all applicable federal, state and local laws and regulations. Void outside eligible area stated and where prohibited by law.
HOW TO ENTER: During the contest period (2/8/11 through 3/24/11) log onto kfdm.com and submit an entry form, found on kfdm.com/contest. Entrants must complete all required information on the entry form to be eligible. Limit one entry per person and per household per week throughout the contest period. Entries received from any person or household in excess of the stated limitation will be void. All entries become the property of the Sponsor and will not be returned. Entries will be collected into a database list and given to Classic Chevrolet for promotional purposes.
FINALIST SELECTION: On or about 4/1/11, six potential finalists (one finalist determined per week, 2/18/11 – 3/25/11) will be eligible for and receive access to the Grand Prize Contest Event described below upon verification of eligibility and compliance with the terms of these Official Rules. Potential finalists will be notified by phone on or about 3/25/11 following conclusion of random drawings. To be eligible, finalists must be available to attend Grand Prize Contest Event at Classic Chevrolet, Friday, April 1, 2011 at 5:30 a.m. If potential finalist is not eligible, not in compliance with official rules, or does not wish to accept the prize as offered, s/he will be disqualified and an alternate finalist will be randomly selected. Limit One Finalist Per Household.
GRAND PRIZE EVENT: On Friday, April 1, 2011, six previously selected finalists will meet in the Classic Chevrolet Showroom for the Final Event. Each finalist will draw a key to potentially start the 2011 Chevrolet Cruze. Finalists will select a number from a bag based on their finalist nomination (person selected on 2/18 will draw first, person selected on 2/25 will draw second, etc) This number determines the order they will select their key. Only one key will start the car. Finalists with keys that do not start the car will be eligible to win a Carnival Cruise voucher. Must be present to win. If forfeited for any reason, Administrator and Sponsor will have no further obligation to winner, and may, at its sole discretion, randomly select an alternate winner.
GRAND PRIZE: One 2011 Chevrolet Cruze LT Sedan with a manufacturer’s Suggested Retail Price not to exceed $21,320. (options to be determined solely by Classic Chevrolet)
FIRST PRIZE: One (1) Carnival Cruise Certificates for 2 people sharing an interior stateroom on Carnival Cruise Lines. Certificates may be upgraded by the recipient for an additional fee. Winner is solely responsible for all expenses, costs or fees associated with acceptance and/or use of the prize not specified herein as being awarded including, without limitation, any and all income, federal, state and local taxes, any or additional ground transportation, luggage fees, meals, gratuitites and souvenirs. Certificate levels include all Carnival sailing itineraries for a 4 day/3 night cruise. Certificates are valid for 18 months. Trip must be taken prior to September 2012 or prize will be forfeited and sponsor will have no further obligation to such winner. Either Finalist or Finalist’s Guest must be 25 years or older by 2/01/11. Winner and guest must travel together on the same itinerary. Valid for travel during the fall with blackouts during the last two weeks of December. Carnival reserves the right to re-instate the fuel supplement for all guests at up to $9 per person per day should the price of light sweet crude oil according to the NYMEX (NewYork Mercantile Exchange Index) increase above $70.00 per barrel. Total Value of Carnival Cruise: Not to exceed $638.

The KFDM/Classic CRUISE IN A CRUZE Giveaway Promotion is open and offered only to legal residents of the State of Texas or the State of Louisiana who are 18 years of age or older as of February 1, 2011, and who have a valid driver’s Texas or Louisiana driver’s license. Employees, officers and sponsors, affiliated and subsidiary companies; their legal advisors, advertising and promotional agencies, and web suppliers for this promotion; as well as the immediate family (spouse, parents, siblings and children, regardless of where they live) or members of the households of such employees, officers or directors (whether or not related), are not eligible. By entering, you agree to these Official Rules and the decisions of Sponsor, which are final and binding in all respects. Void where prohibited.
The Promotion begins on Tuesday, February 8, 2011 at 12:01:00 p.m. Central Standard Time and ends on Wednesday, March 24, 2011 at 11:59 p.m. Central Standard Time (the “Promotional Period”).
1. To enter the KFDM Classic Cruise in a Cruze Giveaway, click the entry button on kfdm.com/homepage or the entry button at kfdm.com/contest. Entry form must be filled out completely to be eligible. Hit submit when you are finished.
2. Television station will host live remotes at Classic Chevrolet beginning Friday, February 18th, 2011, and culminating Friday, April 1st, 2011. All completed entries will be compiled and entered into a random drawing. Each Friday, beginning February 18, 2011 and ending March 25, 2011, one entry will be selected by random drawing (“finalist”) to participate in the final contest. On Friday, April 1, 2011, the six (6) previously drawn finalists will each draw a key to potentially start the 2011 Chevrolet Cruze. Only one key will start the 2011 Chevrolet Cruze. Finalists will randomly draw to determine order to select key. Each finalist will turn the key in the ignition. Must be present to win. Not responsible for lost, late, damaged or misdirected entries. Limit: One entry selected per person. If a duplicate name is selected, another will be drawn to participate in the final.
3. Entrants may not enter with multiple identities nor may entrants use any other device or artifice to obtain more than the maximum number of entries. Any entrant who attempts to participate with multiple identities or uses any device or artifice to obtain more than the maximum number of entries may be disqualified.
4. A total of six (6) finalists will be selected to participate in the final event on Friday, April 1, 2011, at Classic Chevrolet between the hours of 5:30 am and 9:00 am. Must be present to win.
5. One (1) Chevrolet Cruze Car prize will be awarded Friday, April 1, 2011, on KFDM 6 This Morning. Each finalist NOT awarded a car will receive a cruise voucher for a Carnival Cruise for 2, valued at $638 as a consultation prize. A total of five (5) Cruise vouchers will be provided to finalists who are not awarded the Chevrolet Cruze.
6. Judges decisions are final. Approximate Retail Value of Grand Prize: $21,320.
Approximate Retail Value of five Carnival Cruise Packages: $3,250
7. Winners will be required to sign an affidavit of eligibility, advertising and liability release upon notification or prize will be forfeited. All winners agree to use of their names/voices/likenesses in publicity and advertising without further compensation, except where prohibited by law.
8. Legal Acceptance by winner required by 12 Noon on Friday, April 8, 2011, or alternate winner will be chosen. Judges decision is final.
9. No substitution or transfer of prizes permitted. Taxes are sole responsibility of winner. Odds of winning depend on the number of eligible entries received. If a Finalist cannot accept the Prize as stated, the Prize will be forfeited and awarded to an alternate.
Limit: one prize per household or family.
10. Contest open to U.S. residents, 18 years or older. Carnival Cruise Winner or Guest must be at least 25 years old. Ineligible are employees and their families of KFDM-TV, Classic Chevrolet, their affiliates, suppliers, all affiliated companies and subsidiaries and all advertising and promotional agencies. Void where prohibited by law.
General Conditions:
The Finalists must be able to verify they are 18 years of age as of April 1, 2011, have a valid driver’s license and must take possession in person of the 2011 Chevrolet Cruze by April 8, 2011, in Beaumont, TX. Carnival Cruise Winner or Guest must be at least 25 years old. Sponsor may require Finalists to complete, execute and return Affidavits of Eligibility, Liability Releases, and Publicity Releases prior to taking possession of their applicable Prize. If a Finalist fails to sign these documents, or if a Finalist cannot be notified, or if Finalist is found to be ineligible or not in compliance with these Official Rules, then the Finalist will be disqualified and an alternate Finalist will be selected. By accepting the Prize, where permitted by law, Finalists grant to Sponsor and those acting pursuant to Sponsor’s authority (and agrees to confirm said grant in writing) the right to use and publish his/her name, biographical information, statements made regarding the Sponsor, or the Promotion (provided same are true), portrait, picture, voice and likeness for trade, advertising and promotional purposes without additional consideration, or notification, review or approval, worldwide, and on the Internet. By participating, entrants release and agree to hold harmless Sponsor and its parents, affiliates, and subsidiary companies, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injury, loss or damage of any kind to person, including death, and property arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the Prize, participation in any Promotion related activity, or participation in this Promotion.
Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or web site; to be acting in violation of the Official Rules; to be acting in violation of the terms of the web site, or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, macro, automatic, programmed or the like entry methods will void all such entries by such methods and subject any participant using any such method to disqualification.
Limitations of Liability:
Sponsor is not responsible for any incorrect or inaccurate information, whether caused by web site users, or by any of the equipment or programming associated with or utilized in the Promotion and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of, the web site or any technical failure of malfunction. Sponsor is not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Promotion or downloading or copying materials from or use of the web site. If, for any reason, the Promotion is not capable of running as planned by reason of infection by computer virus, bugs, worms, tampering, hacking, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of Sponsor, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion, and select the winner from entries received prior to the action taken, or as otherwise deemed fair and equitable by Sponsor. IN NO EVENT WILL SPONSOR, THEIR PARENTS, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF SPONSOR’S INTERNET SITES OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITES. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THESE SITES IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. Arbitration/Choice of Law:
Except where prohibited by law, entrants agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Promotion, or any prize awarded, or the determination of the winner shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association then effective; and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Texas, without regard for conflicts of law doctrine, and all proceedings shall take place in Beaumont, TX.
